By means of this data protection declaration, our law office would like to inform the public about the type, scope and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed of their rights by means of this data protection declaration.

Collection and storage of personal data and the nature and purpose of their use

The following information refer to the use of our website with mobile end devices, e.g. smartphones or tablets. In this context, personal data is all data with which you can be personally identified, or which makes you identifiable via an identifier, for example via your IP address.

Data collection on this website

How do we collect your data?

On the one hand, your data is collected by you providing it to us. For example, this may be data that you send us by e-mail or provide to us via a telephone call. Other data is collected automatically or with your consent by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of page access). This data is collected automatically as soon as you enter this website.

When visiting our website

When you visit our website www.schuetz.law, information is automatically sent to our website server by the browser used on your end device. This information is temporarily stored in a log file. The following information is collected without and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • name and URL of the file accessed,
  • website from which the access was made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The aforementioned data is processed by us for the following purposes:

  • Ensuring a smooth connection set-up of the website,
  • Ensuring a comfortable use of our website,
  • evaluating system security and stability, and
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 (1) s. 1 lit. f DSGVO. Our legitimate interest follows from the data collection purposes listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

Enquiry by e-mail

If you have any questions, we offer you the possibility of contacting us by e-mail. It is necessary to provide a valid e-mail address so that we know who the enquiry is from and so that we can answer it. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is based on your voluntarily given consent in accordance with Art. 6 (1) s. 1 lit. a DSGVO.

If you send us an e-mail, we will collect, store and process your data only to the extent necessary to process your enquiries and for correspondence with you.

We would like to point out that when sending e-mails, data transmission via the Internet is partly unsecured and the data could therefore theoretically be accessed or falsified by unauthorised persons. The contact e-mail addresses provided are not prepared for all e-mails with digital signatures or with all encryption methods.

Why do we use your data?

Some of the data is collected to ensure that the website is provided without error. Other data may be used to communicate with you.

Transfer of data

We do not transfer your personal data to third parties for purposes other than those listed below.

We only pass on your personal data to third parties if:

  • you have given your express consent to this in accordance with Art. 6 (1) s. 1 lit. a DSGVO,
  • the disclosure is necessary for the assertion, exercise or defence of legal claims in accordance with Art. 6 (1) s. 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that there is a legal obligation to disclose your data pursuant to Art. 6 (1) s. 1 lit. c DSGVO, as well as if this is legally permissible and necessary pursuant to Art. 6 (1) s. 1 lit. b DSGVO for the processing of contractual relationships with you.

Data security

We use the widespread SSL procedure (Secure Socket Layer) in connection with the highest level of encryption supported by your browser when you visit our website. Normally this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is encrypted by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.

Link with social media platforms

We do not use any social plug-ins as active buttons in our online offer. We only refer to our offer in the following social networks via icons:

  • LinkedIn, LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland.
  • Xing: New Work SE, Dammtorstraße 30, 20354 Hamburg, Germany
  • Facebook: Facebook Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

We only display the social media icons on our site. They are designed as inactive icons with a link to the respective social media platform.

If you click on such a social media icon on our site, a connection to these third-party providers is established via your web browser in a separate tab (tab card). These third-party providers can thereby track your visit to our pages. If you are a member of one of the social networks, you can share the content of our site with other members from your social network by activating the button.

Through your participation in social networks or by visiting or calling up our social media sites, your data may be processed outside the EU. This may result in risks, for example because it may be more difficult to enforce your rights.

When you access a social network, cookies are usually stored on your end device to record user behaviour. If you have a user account on the respective network and are logged in there, your usage behaviour can be saved to your user account. The social networks can analyse the usage behaviour and use it for market research and advertising purposes. This may result in advertising being displayed to you within and outside the social networks. We have no influence on this.

We have no influence on the personal data collected and stored by the social networks. Through our above-mentioned social media presences, we receive evaluations of user data and can address users with interest-based advertising. If users interact with our social media presence and are logged in with a user account, we can in principle also recognise the user profile and see the content of comments or postings on our presence. This data processing is therefore carried out under joint responsibility with the respective provider of the social network. For the evaluation of data in connection with our social media presences, we have therefore concluded a joint responsibility agreement with the providers in each case (Art. 26 DSGVO). In this agreement, we have undertaken to provide you with this information on data protection. You can find further information in the data protection provisions of the respective social networks. You can also assert the rights to which you are entitled against us. However, the provider of the social network can fulfil your rights more comprehensively because the data for use and evaluation is also stored there.

Plugins and tools

Google Web Fonts (local hosting)

This site uses so-called web fonts provided by Google for the uniform display of fonts. The Google Fonts are installed locally. There is no connection to Google servers.

Your browser sets a session cookie when you visit our website. A session cookie stores information that maps online activity to a single browser session. This website is hosted by an external service provider (hoster). The personal data collected on this website is stored on the hoster’s servers. The hoster is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 (1) s. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 (1) s. 1 lit. f DSGVO).

Our hoster will only process your data insofar as this is necessary for the fulfilment of its service obligations and follow our instructions with regard to this data.

Order processing

We have concluded an order processing agreement (AVV) with the above-mentioned provider. This is a contract required by data protection law, which ensures that the provider only processes the personal data of our website visitors in accordance with our instructions and in compliance with the DSGVO.

Data subject rights

You have the right:

  • In accordance with Art. 15 DSGVO, to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 DSGVO, to demand the immediate correction of inaccurate or incomplete personal data stored by us;
  • in accordance with Article 17 DSGVO, to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;
  • in accordance with Art. 18 DSGVO, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller;
  • revoke your consent at any time in accordance with Art. 7 (3) DSGVO. This has the consequence that we may no longer continue the data processing based on this consent in the future; and
  • complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace for this purpose.

Right of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) s. 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.
